PRIVACY POLICY

Processing of Personal Information

In this clause , the following terms shall bear the following meanings:

“Group” means OpenBox.Africa, its holding company and the subsidiaries, affiliates and sister- companies of OpenBox.Africa and/or its holding company;

“Personal Information” means information relating to an identifiable, natural or juristic person, as defined in POPI;

“Process” means any operation or activity, whether automated or not, concerning Personal Information, as defined in POPI and “Processing” shall have a similar meaning;

“POPI” means the Protection of Personal Information Act, No. 4 of 2013 as amended, replaced or re-enacted from time to time; and

“Data Subject” shall mean each of the Supplier and the Debtor(s).

OpenBox.Africa shall be entitled, on receipt of the Supplier’s Offer and at any time thereafter, at its discretion and without any further action being required on its part, to; request and receive any of the Data Subject’s, and any of the Data Subject’s shareholders, directors, members, partners or the like, confidential information, commercial information, consumer credit information and Personal Information from any credit bureau, other register or any third party or API at any time, including any bureau score, or any South African Credit and Risk Reporting Association or SACRRA Payment Credit and Risk Data and any information that would usually be masked (if required), whether in online or batch form, for the Purpose outlined below, to verify the existence of a bank account, to access bank account statements, to verify the Data Subject’s information (and any information of its shareholders, directors, members, partners or the like), to manage the Data Subject’s account on the OpenBox.Africa System, to conduct a risk assessment of the Data Subject and to manage any ongoing risk relating to OpenBox.Africa’ relationship with the Data Subject, including the collection of any Approved Claim from theApproved Debtor. OpenBox.Africa may also share any confidential information, commercial information, consumer credit information and Personal Information held by it (including information regarding non- compliance with any obligations under this Agreement or any Invoice), with its Group, with any other persons using the OpenBox.Africa System, with any APIs used by the Data Subject through an interface with the OpenBox.Africa System and with any credit bureau for, amongst other things, the purposes of such credit bureau sharing such information with potential data users, credit providers and credit bureaus; and

OpenBox.Africa shall be entitled to retain all of the information referred to in the above for a period of 5 years after the de-registration of the Debtor from the OpenBox.Africa system, or for such other periods as may be prescribed or permitted by law, whichever is the longer. OpenBox.Africa shall not be obliged to disclose any confidential information, commercial information, consumer credit information or Personal Information to the Data Subject, but should it do so, the Data Subject shall treat such information in strict confidence and shall not allow such information to be passed on to any other person and OpenBox.Africa shall incur no responsibility or liability whatsoever should such information prove to be incorrect or untrue.

The Supplier hereby indemnifies OpenBox.Africa and holds it harmless against any claim of whatsoever nature brought against OpenBox.Africa by any person whatsoever, arising out of such statement made or information given.
